Two felony criminal cases scheduled for open sentencings Friday

A judge is scheduled to hear from attorneys before determining sentences for Patrick R. Andrews and James L. Folsom Friday in Dillingham.

Two felony criminal cases are scheduled to come to a close this week. James Folsom Jr. of Dillingham and Patrick Andrews of Aleknagik have both pleaded guilty and will be sentenced at open hearings Friday at the Dillingham court. KDLG’s Dave Bendinger has more:

Patrick Ray Andrews, 23, of Aleknagik, pleaded guilty last September to sexually assaulting two women.

Andrews' first victim was assaulted in Aleknagik at the end of July 2012. Andrews was arrested, posted bail and was released. Less than six months later he sexually assaulted another woman at her home in Dillingham. He has remained in custody since that time on a much higher bail.

Andrews pleaded guilty to one count of second degree sexual assault and one count of attempted first degree sexual assault. The state’s prosecutor is recommending a total of 34 years active jail time to be served, the majority of that time coming from the attempted first degree sex assault (which was the second incident). His attorney says Andrews does not dispute the facts of the case, but he is arguing that Andrews only be sentenced to 22 years of active jail time.

Another case scheduled for sentencing Friday is that of James. L Folsom Jr., a 28 year old from Dillingham who goes by Jim Bob. He was arrested attempting to sell heroin in Koliganek in November 2012.

James Folsom Jr., 26, was arrested and more than four grams of black tar heroin were seized in the bust. His wife Patricia was arrested on Friday afternoon, charged with simple possession and tampering with evidence. KDLG's Dave Bendinger has more on this, and on black tar heroin, which WAANT officers say is becoming an increasingly prevalent, and problematic, drug in this region:

Authorities were tipped off to his activities, and the WAANT unit, Dillingham police, and Koliganek VPSO worked together on the bust. They found 4.5 grams of black tar heroin (about 45 doses worth), bundles of cash totaling over $2700, and a .357 magnum revolver.

Last fall Folsom pleaded guilty to attempted second degree misconduct involving a controlled substance.

The state is recommending 18 months of active jail time for Folsom, plus three years of probation and a $5000 fine.

The presiding judge in both cases is Valdez-based Daniel Schally. Both defendants agreed to open sentencings, meaning Judge Schally will hear from the prosecution, defense, and any witnesses before he determines the actual sentences for each man.
